Sarah Wilkerson, the Commissioner of the Division of Occupational Licensure, recently announced that the Massachusetts Secretary of the Commonwealth will officially promulgate the 10th Edition of the Base Building Code (780 CMR) with Massachusetts Amendments, effective on Friday, October 11, 2024.
At this time, the concurrency period with the 9th Edition is scheduled to extend until January 1, 2025. Note that at the September 10 meeting of the Board of Building Regulations and Standards (BBRS), board members agreed to place an item on their October 8 meeting agenda to discuss extending the concurrency period past January 1, 2025. BBRS members agreed that because the code had still not been promulgated when they met on September 8, the previously agreed upon six-month concurrency period ending January 1, 2025, should be readdressed.
By providing for a “concurrency period,” builders and design professionals may choose to use either the current 9th Edition or the 10th Edition of the State Building Code. This is critically important for projects that have already been designed and financed, but have not started construction, prior to the adoption of the new code.
